Introduction and Acceptance of Terms
Welcome to Web Collective FZE. These Terms of Service ("Terms") govern your access to and use of our website at webcollective.co and the services we provide. By accessing our website, submitting an inquiry, subscribing to our content, or engaging with our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Web Collective FZE is a company registered in the United Arab Emirates under license number 4424122.01. We provide a comprehensive range of digital services spanning development, design, and growth marketing. Our approach is consultative and project-based, focused on building long-term partnerships with clients who value quality, expertise, and strategic thinking.
If you do not agree with any part of these Terms, you should not use our website or services. We encourage you to read these Terms carefully, along with our Privacy Policy and other policies referenced herein, as they form the complete agreement between you and Web Collective FZE regarding your use of our website and services.
These Terms apply to all visitors, users, subscribers, and clients of our website and services. Different or additional terms may apply to specific services we provide, which will be communicated to you separately as part of our project agreements or service contracts.
Description of Services
Web Collective FZE offers professional digital services across three primary practice areas: Build, Design, and Grow. Our services are consultative and customized to each client's unique needs, goals, and context. We do not offer standardized, off-the-shelf products; instead, we work collaboratively with clients to develop tailored solutions.
Build Services
Our development services encompass the full spectrum of technical implementation required to bring digital experiences to life. This includes front-end development, where we create responsive, performant user interfaces using modern frameworks and best practices. We provide back-end development services, building robust server-side applications, databases, and business logic that power digital experiences.
We specialize in API development and integration, connecting disparate systems and enabling seamless data flow between platforms. Our mobile app development capabilities span native and cross-platform solutions for iOS and Android. We design and implement database architecture that ensures data integrity, performance, and scalability.
We work extensively with headless CMS and content systems, enabling flexible content management that supports omnichannel delivery. Our cloud infrastructure and DevOps services help clients build reliable, scalable, and secure digital infrastructure. We implement and customize ecommerce platforms, enabling businesses to sell effectively online. We also create interactive experiences that engage users through thoughtful use of animation, interactivity, and creative technology.
Design Services
Our design practice focuses on creating experiences that are both beautiful and functional, grounded in user needs and business objectives. We provide brand identity and strategy services, helping organizations articulate who they are and how they present themselves to the world.
We develop comprehensive design systems that ensure consistency and efficiency across digital touchpoints. Our user interface design work emphasizes clarity, usability, and visual appeal, creating interfaces that people enjoy using. Our user experience design process is research-driven and iterative, focused on understanding user needs and designing solutions that meet them effectively.
We conduct prototyping and testing to validate design decisions before development begins, reducing risk and ensuring we're building the right solution. We create visual assets and iconography that support brand identity and enhance user experience across all touchpoints.
Grow Services
Our growth marketing services help clients attract, engage, and convert their target audiences through strategic, data-driven approaches. We provide search engine optimization (SEO) services, helping websites rank for relevant keywords and attract organic traffic. Our paid search (SEM/PPC) services manage advertising campaigns across platforms like Google Ads, optimizing for performance and return on investment.
We develop conversion strategy and optimization programs, systematically improving the effectiveness of digital experiences at turning visitors into customers. Our analytics and attribution services help clients understand what's working and why, enabling data-informed decision-making.
We create content strategies that align with business goals and audience needs, establishing thought leadership and driving engagement. We implement marketing automation systems that enable personalized, scalable communication with prospects and customers.
Additional Industry-Specific Services
eyond our core service offerings, we provide specialized services tailored to specific industries and use cases. These services are showcased on our website but typically don't have standard pricing due to their custom nature. We're happy to discuss how our capabilities might apply to your specific situation.
The Nature of Our Engagement
Our services are engagement-based and project-driven. We don't offer fixed-price products because every client's needs are different. Instead, we work with you to understand your goals, challenges, and context, then propose an approach that makes sense for your situation. Our process typically begins with a discovery or strategy phase, where we invest time in understanding your needs before recommending solutions.
Projects may range from discrete, time-bound engagements to ongoing partnerships involving multiple workstreams. We're flexible in how we structure our engagements and aim to find approaches that work for both parties.

You agree to provide accurate, current, and complete information in your inquiry submissions. Providing false, misleading, or deceptive information is a violation of these Terms.
We review all inquiries we receive, but submitting an inquiry does not create a client relationship or obligate us to provide services. We'll respond to inquiries as our capacity and priorities allow. Attribution Requirements
If we grant you permission to use our content, or if you're using our content in ways that constitute fair use, proper attribution is required. Attribution should include our name (Web Collective FZE), the title of the work, the URL of the original content if applicable, and a copyright notice.

Client Work and Project Intellectual Property
For projects we complete for clients, intellectual property rights are typically addressed in separate project agreements. Generally, upon full payment, clients receive the rights to use the deliverables we create for their intended business purposes. However, we typically retain certain rights, such as the right to display project work in our portfolio (with client approval), discuss project approaches in case studies (with client approval), and use general methodologies and techniques developed during the project.
Specific intellectual property arrangements vary by project and are detailed in individual client agreements. If you have questions about intellectual property rights related to a project, please refer to your client agreement or contact us for clarification.
DMCA Compliance
Web Collective FZE respects the intellectual property rights of others and expects users of our services to do the same. Please note that under the DMCA, anyone who knowingly makes material misrepresentations may be subject to liability for damages.
Disclaimers and Limitations of Liability
General Information Disclaimer
The content on our website is provided for general informational and educational purposes. While we strive to ensure that all information we publish is accurate, current, and useful, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics contained on our website.
The digital landscape changes rapidly. Technologies evolve, best practices shift, and what's true today may be outdated tomorrow. While we work diligently to keep our content current and accurate, we cannot guarantee that every piece of information on our site reflects the absolute latest developments in our industry.
Professional and Technical Advice Disclaimer
The content on our website, including our resources and thought leadership pieces, is intended to inform and educate. However, it should not be construed as professional advice specific to your situation. Every business is unique, with its own challenges, opportunities, and context. What works for one organization may not be appropriate for another.
If you're making significant business decisions related to web development, design, or digital marketing—particularly decisions involving substantial investment or strategic importance—we strongly recommend engaging with qualified professionals who can assess your specific situation. While we're happy to provide general guidance and insights through our content, personalized professional advice requires a proper assessment of your unique circumstances.
Our services are consultative and project-based precisely because we recognize that effective solutions require understanding your specific context, goals, and constraints. Information on our website is a starting point for conversation, not a substitute for that deeper engagement.
Third-Party Links and External Content
Our website may contain links to external websites, tools, resources, or services that are not owned, controlled, or operated by Web Collective FZE. These links are provided for convenience and informational purposes only. We include links to external resources that we believe may be useful or interesting to our audience, but inclusion of a link does not imply endorsement.
We have no control over and assume no responsibility for the content, privacy policies, practices, or availability of third-party sites or services. We do not review, monitor, or verify the information on linked sites, and we cannot guarantee their accuracy, completeness, or appropriateness.
When you click on external links, you leave our website and are subject to the privacy policies and terms of service of the external site. We encourage you to review these policies before providing any personal information or engaging with external services. We are not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods, or services available through external websites.
Results and Outcomes Disclaimer
When we share case studies, project examples, or results achieved for clients, we're showcasing specific instances of our work. These examples represent actual projects and real outcomes, but they should not be interpreted as a guarantee of similar results for your project.
Results in web development, design, and digital marketing depend on numerous factors, many of which are outside our control. These include your specific market conditions, competitive landscape, budget, timeline, internal resources, the quality and timeliness of information and materials you provide, and countless other variables unique to your situation.
While we bring expertise, experience, and dedication to every project, we cannot guarantee specific outcomes, rankings, conversion rates, traffic levels, or business results. Our commitment is to apply our best efforts, knowledge, and skills to your project, but ultimate results depend on many factors beyond the quality of our work alone.
Technology and Compatibility Disclaimer
Technology evolves constantly, and what works perfectly today may encounter issues tomorrow due to browser updates, platform changes, third-party API modifications, or other factors beyond our control. While we build our solutions using current best practices and modern, maintainable technologies, we cannot guarantee that websites or applications will function flawlessly in all environments, on all devices, or indefinitely without maintenance.
We recommend ongoing maintenance and updates for digital properties, and we're happy to discuss maintenance arrangements for projects we've delivered. However, unless explicitly covered by a maintenance agreement, we're not responsible for issues that arise after project delivery due to environmental changes, lack of updates, or other factors outside our control.
Limitation of Liability
To the fullest extent permitted by applicable law, Web Collective FZE, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use our website or services, any content obtained from our website, or any conduct or content of any third party on our website.
This limitation applies regardless of the legal theory on which the claim is based—whether contract, tort, negligence, strict liability, or otherwise—even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from or related to our website or services shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred US dollars ($100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
AS-IS and AS-AVAILABLE Basis
Our website and the information, content, and materials it contains are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Web Collective FZE disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our website will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that our website or the server that makes it available are free of viruses or other harmful components.
Forward-Looking Statements
Our website may contain forward-looking statements about our services, capabilities, industry trends, or future developments. These statements reflect our current expectations and beliefs but are subject to risks, uncertainties, and assumptions. Actual results, outcomes, or developments may differ materially from those expressed or implied in forward-looking statements.
We undertake no obligation to update forward-looking statements to reflect events or circumstances occurring after the date of the statement or to reflect the occurrence of unanticipated events.

You agree to defend, indemnify, and hold harmless Web Collective FZE, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our website or services, including but not limited to your User Contributions (if applicable), any use of the website's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the website.
Governing Law and Dispute Resolution
Governing Law
These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any choice or conflict of law provision or rule.
Jurisdiction and Venue
Any legal suit, action, or proceeding arising out of or related to these Terms or the website shall be instituted exclusively in the courts of the United Arab Emirates. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Dispute Resolution Process
Before filing any claim, you agree to try to resolve the dispute informally by contacting us at hello@webcollective.co. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, either party may bring a formal proceeding.
We're committed to working in good faith to resolve disputes amicably whenever possible. Most issues can be resolved through open communication, and we encourage you to reach out to us directly if you have concerns.
Waiver of Class Actions
You and Web Collective FZE agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than through arbitration, you and Web Collective FZE each waive any right to a jury trial.

Waiver
No waiver by Web Collective FZE of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
